Fake News Or Censorship? Bombay High Court's Split Judgment On IT Rules

In a split judgement on petitions challenging the amended Information Technology (IT) Rules on fake news, one judge of the Bombay High Court on Wednesday held that they amounted to censorship, while the other judge said the Rules do not have any chilling effect on free speech.

A division bench of Justices Gautam Patel and Neela Gokhale delivered different judgements, necessitating the placing of the petitions before a third judge. Patel struck down the Rules in question, terming them as unconstitutional, while Gokhale dismissed the petitions.

The matter would be put before the Chief Justice of the HC to be assigned to a third judge, the division bench said.

"There is a disagreement between us. I have held for the petitions and Justice Gokhale has held for the government. So now the matter will be heard afresh by a third judge," Justice Patel said.

Solicitor General Tushar Mehta agreed to extend for ten days an earlier assurance that until the judgment was delivered, the government would not notify the Fact Checking Unit (FCU) to be set up under the Rules to flag fake news about government on social media.

Under the Rules, if the FCU comes across or is informed about any posts pertaining to the business of the government that are fake, false, and contain misleading facts, then it would flag off the same to social media intermediaries.

The intermediary has the option of either taking down the post or putting a disclaimer on it. In the second option, the intermediary loses its safe harbour/ immunity and stands liable for legal action.

Patel held that no fundamental right says that every citizen has to receive only "true and accurate information as determined by the government".

Gokhale, on the other hand, held the right to share fake or untrue information was not part of the free speech right.

"Right of speech will not enjoy protection if the user knowingly and intentionally shares fake or misleading information, flagged albeit by a FCU...," she said.

Patel noted that the FCU would be "the sole authority to decide what piece of user-content relating to the undefined and unknowable business of the government is or is not fake." "How the FCU will go about its business is also unknown....Who, after all, is to fact-check the fact checker?...Quis custodiet ipsos custodes (Who will guard the guards)?"he asked.

"It is not the business of the government to keep citizens from falling into error. It is other way around...it is very much business and should be the duty of every citizen to prevent the government from falling into error," he said, adding that every attempt to whittle down a fundamental right must be resisted.

Justice Gokhale held that the Rules were not violative of any fundamental rights, nor did they suffer from arbitrariness.

The Rules, in fact, encourage discussion and dissemination of information on facts bereft of fakery, she said.

"No content is restrained by the impugned Rule, unless the content is patently false, untrue and is communicated with actual malice that is with knowledge of its falsehood and with reckless disregard for the truth and is deceptively passed off as a statement of truth," she said.

"The right to free expression is a crucial and indispensable component of a nation having adopted democracy. However, this right does not permit freedom to share information which a person knows to be false yet intentionally communicates as authentic," Gokhale said.

Justice Patel held that the State cannot coercively classify speech as true or false and compel non-publication of the latter, as this was nothing but "censorship".

He had the greatest difficulty in accepting the proposition that the government has an overriding authority to arrive at an absolutist determination of a content or expression as the truth, the judge said.

"There are no guidelines, no procedure for hearing, no opportunity to counter the case that some information is fake, false or misleading.... the Rules clearly make the Central Government a judge in its own cause.

Gokhale, however, noted that the Rules provide an opportunity to the intermediary to put a disclaimer on the content, and the FCU was merely tasked with identifying information concerning any business related to the government.

"The Rules does not in any manner, confer any authority on the FCU to direct the intermediary to take down any such information. It is left entirely to the discretion of the intermediary to make reasonable effort so that the user is encouraged not to continue to post, share etc. such information," she said.

She further said there was also a redressal mechanism for the intermediary as well as the user, and ultimately it is the court of law which would be the final arbiter. FCU cannot be presumed to be biased only because the power to notify is vested in the government, she added.

Members of the FCU would be those who are privy to the business or policies of the government, having access to authentic information to authoritatively determine any information as fake, and hence the FCU cannot be termed as biased, Justice Gokhale said.

Patel noted that one fully government-controlled entity, Press Information Bureau, is active and already has significant social media presence.

"The sinister and insidious facet to the impugned amendment is that this new agency (FCU) has far more than a loud bark: it has fangs and claws, for its unilateral view of what is or is not the 'truth' is accompanied by a requirement of removal of what is has so determined (to be fake, false or misleading)," he said.

Stand-up comedian Kunal Kamra, the Editors Guild of India, and Association of Indian Magazines filed petitions in the HC against the Rules, terming them arbitrary and unconstitutional and claiming that they would have a chilling effect on the fundamental rights of citizens.

On April 6, 2023, the Union government promulgated amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including a provision for a fact-checking unit.

Congress, DMK Hold "Very Satisfactory" Talks For Lok Sabha Poll Alliance

Tamil Nadu's ruling DMK held its first round of talks with key ally Congress on Sunday for the Lok Sabha polls, a meeting described as "very satisfactory" by the grand old party.

After the meeting with DMK leaders at the party's headquarters 'Anna Arivalayam', Tamil Nadu Congress Committee President K S Alagiri briefed reporters, stating that the discussions revolved around potential candidates and campaign strategies aimed at securing seats in the parliamentary elections.

He said the first round of talks with the DMK was very satisfactory and they would soon take things forward.

Congress leaders Salman Khurshid, Mukul Wasnik, AICC in-charge for Tamil Nadu Ajoy Kumar, and Congress Legislature Party leader K Selvaperunthagai participated in negotiations.

DMK's T R Baalu, addressing reporters after the seat-sharing discussions, indicated that the preliminary talks had concluded, and the next round would follow soon.

Responding to a query, the DMK treasurer and MP clarified that neither had the Congress party submitted a "list of preferred seats", nor had the DMK sought one.

In the 2019 Lok Sabha polls, the DMK and its allies secured 38 out of the 39 LS seats in Tamil Nadu, of which the Congress won 9 of the 10 segments it contested.

On speculation about the Congress expecting more seats, he stated that it is natural for all alliance partners, including the DMK, to try and contest from the maximum number of seats. "When several parties form part of an electoral alliance, all partners should be accommodated," he remarked.

Regarding the prospects of new parties joining the DMK-led alliance in Tamil Nadu, Baalu welcomed any outfit that "does not seek LS seats." When asked specifically about the possibility of Makkal Needhi Maiam, led by actor-politician Kamal Haasan, joining the alliance, he claimed he was "not aware" of such developments.

DMK General Secretary Duraimurugan had on January 19 announced that a committee led by party Treasurer Baalu would hold talks with allies on seat-sharing.

Principal Party Secretary K N Nehru, Deputy General Secretaries I Periyasamy, K Ponmudi and A Raja, who is also an MP, were present during the committee's discussions, along with panel member MRK Panneerselvam.

No Disrespect: Tamil Nadu Governor Clarifies Speech Involving Gandhi

Tamil Nadu Governor R N Ravi on Saturday said he didn't disrespect Mahatma Gandhi while speaking on India's Independence struggle and asserted that the Father of the Nation has been the guiding light of his life.

Some media reports in the last three-four days sought to create "an erroneous impression" that he has been "disrespectful" to Mahatma Gandhi but nothing could be farther from the truth, he said.

"I hold Mahatma Gandhi, the Father of the Nation, in the highest regard and his teachings have been the ideals of my life," the Governor stated.

His clarification comes in the wake of the agitation by the TNCC members held here earlier in the day condemning the Governor for allegedly insulting the Mahatma and belittling his role in the freedom struggle.

TNCC chief K S Alagiri, Su Thirunavukkarasar, MP, and Congress Legislature Party leader K Selvaperunthagai, were among those who participated in the agitation.

"I did not mean any disrespect to Mahatma Gandhi whose teachings have been the guiding light of my life," a Raj Bhavan communique quoting Ravi said referring to his speech at the 127th birth anniversary of Netaji Subhas Chandra Bose on January 23, here.

Some media "did cherry-pick" from the speech and "gave it a twist," he said. "In my speech, I sought to elaborate the point that Netaji's significant contributions to our nation's Independence has not been adequately appreciated. I tried to make a point that what accelerated the pace and process of Independence in 1947 were the revolts of the Royal Indian Navy and Air Force in February 1946 – both inspired by Netaji," the Governor said.

Due to these revolts, the British panicked as they could no longer trust the Indians in uniform for their own safety and security in India. Following the February revolts, in March the British publicly declared that they would leave India and constituted the Constituent Assembly to demonstrate their sincerity, assuage the feelings of the agitated Indians and pre-empt potential revolts which could have had existential consequences for the British officers and their families in India.

The Naval and Air Force revolts were greatly inspired by the revolutionary actions of Netaji including the war of the Indian National Army against the British, he said.

The Quit India Movement of August 1942, after initial success had lost steam. Internecine conflicts in the National Freedom Movement due to the Muslim League's vehement insistence on the partition of India and its reactions on the ground kept much of the efforts and energy of the Congress leaders on how to manage the internal conflicts, much to the delight of the British.

"The British could have ruled India for some more years but for Netaji's armed revolution and its domino effect on the Indian Military and Security Forces. What I have said are facts based on primary documents," Ravi stated.

"Congress Like Ocean, Unaffected": DK Shivakumar On Jagdish Shettar's Exit

After former Karnataka Chief Minister Jagadish Shettar returned to the BJP barely months after joining Congress, Deputy Chief Minister DK Shivakumar on Friday likened the Congress to an ocean and said that the exit of one individual does not make any difference to the party.

Speaking to reporters at the KPCC office, he said, "The Congress party is an ocean. It stays unaffected irrespective of anyone joining or leaving. Many people are looking forward to joining Congress too."

DK Shivakumar further claimed that despite the BJP trying to establish contact with him for the last 2-3 months, Mr Shettar was determined to stay in the party for a couple of days.

"Jagadish Shettar had joined the Congress after his disillusionment with the internal affairs of the BJP. He had even made big accusations against the BJP. We had accommodated him as an MLC despite his loss by 35,000 votes in the last assembly elections. Despite the BJP trying to establish contact with him for the last 2-3 months, Mr Shettar was determined to stay in the party till a couple of days," he said.

"We had accommodated him with a long-term view. Congress party leaders and workers from the Belagavi district are happy about his exit. The MLC seat that is vacated after his exit will be given to a loyal party worker," he added.

Asked if the Congress party will take in only those who come based on ideology, he said, "Anything can happen in politics. We had supported the JDS to keep the BJP away. But today he has joined hands with the BJP, which brought down his government. Both JDS and Kumaraswamy are working as spokespersons of the BJP today. Everyone knows the language Kumaraswamy used against the BJP when his government was brought down. Today's politics is shameful. Power comes and goes but we need to do clean politics."

Referring to AICC President Mallikarjun Kharge's comments that the party should induct only those who are aligned with the party ideology, Shivakumar said, "We will certainly follow the instructions of our senior leaders."

On being asked if the BJP would try to bring down the Congress government in the state post the Lok Sabha elections, the Deputy Chief Minister said, "The BJP may be in that situation post the elections. I don't think anything will happen to the Congress government."

Security Tightened In Imphal As Manipur Ministers To Meet This Key Group

Security has been tightened in and around Manipur capital Imphal after Arambai Tenggol asked all ministers and MLAs from the valley districts for a meeting at Kangla Fort on Wednesday.

Arambai Tenggol, an organisation of around 50,000 people engaged in guarding villages in the valley areas of the state, has asked all ministers and MLAs from the valley districts to come for discussions, the details of which have not been specified, an official said, adding "there are intel reports that they (Arambai Tenggol) are planning to enter Kangla fort with arms before the meeting."

According to the officials, a large number of security forces including CRPF, Assam Rifles, Army and state police have been deployed near the fort as a precautionary measure.

Kangla Fort served as the royal seat of Manipur kingdom till 1891.

Earlier too, Arambai Tenggol had asked all legislators to attend a meeting at Kangla Fort, the official said.

The development comes a day after a three-member Union home ministry team met the leaders of the group at the residence of Rajya Sabha MP Leishemba Sanajaoba on Monday, the official added.

The group has demanded delisting of Kukis from the ST list, deportation of refugees to camps in Mizoram, border fencing, replacement of Assam Rifles with other paramilitary force and revoking Suspension of Operations (SoO) agreement between Centre and Kuki militant groups, officials said.

The central team included former Intelligence Bureau special director AK Mishra, SIB New Delhi joint director Mandeep Singh and SIB Imphal joint director Rajesh Kamble.

Kerala Invites MK Stalin To Join Protest In Delhi Against Centre On Feb 8

The Left government in Kerala has invited Tamil Nadu Chief Minister M K Stalin to join a protest organised by Chief Minister Pinarayi Vijayan and his cabinet colleagues against the alleged negligence towards the southern state by the BJP-led Centre in New Delhi next month.

The protest is scheduled for 11 am at Jantar Mantar in Delhi on February 8.

The invitation letter from the Kerala Chief Minister to MK Stalin was handed over by state Industries Minister P Rajeev in Chennai, according to an official release here on Monday.

During the meeting, Mr Stalin expressed the view that the union government's policy of financially squeezing the states should be collectively opposed.

Mr Rajeev presented the details of the petition filed by Kerala in the Supreme Court on this matter.

The Kerala minister alleged that the Union government is withholding the state's due share.

Mr Rajeev claimed that the Modi government is taking a negative approach on various issues, including project allocation, tax allocation, assistance to reduce revenue deficit, and GST compensation.

He also accused the BJP-ruled Centre of denying the right to borrow.

Mr Rajeev alleged that, besides Kerala, the central government is adopting a policy of discrimination against all states governed by non-BJP parties.

He said that, at this stage, the presence of Mr Stalin, the Chief Minister of Tamil Nadu, is expected at Kerala's protest.

Tamil Nadu Finance Minister Thangam Thennarasu and Tamil Nadu Chief Secretary Sivadas Meena also attended the meeting, the release said.

The LDF government has planned various programmes to spread the message of the protest to the people, including house visits across Kerala on a booth basis from 4 pm to 6 pm on the day of the protest.

The Congress-led UDF in Kerala has rejected the ruling LDF's call for a joint strike against the central government in New Delhi, citing disagreement with the CPI(M)-led government's narrative that attributes the state's financial challenges solely to neglect by the union government.

Ram Lalla's Gold Crown, Worth Rs 11 Crore, Gifted By Surat Industrialist

A gold jewelled crown with precious stones adorning the Ram Lalla idol at the new temple in Ayodhya and two silver replicas of the shrine were precious gifts from Gujarat's Surat that shone at the consecration ceremony led by Prime Minister Narendra Modi on Monday, people familiar with the matter said.

The silver replicas of the majestic temple weighing 3 kgs, which were gifted by Uttar Pradesh Chief Minister Yogi Adityanath to PM Modi and Rashtriya Swayamsevak Sangh (RSS) head Mohan Bhagwat after the 'pran pratishtha' (consecration) ceremony in Ayodhya, were made by a Surat jeweller.

The new Ram Lalla idol was consecrated at the Ayodhya temple in an event led by PM Modi and watched by lakhs of people on television at their homes and in temples across the country. PM Modi took part in the 'pran pratishtha' rituals in the presence of Uttar Pradesh Governor Anandiben Patel, Yogi Adityanath and RSS Chief Bhagwat.

Surat-based industrialist Mukesh Patel, who heads Greenlab Diamonds, gifted a Rs 11-crore golden crown for the Lord Ram idol which is embedded with precious stones and weighs six kgs. The silver temple replicas weighing three kgs were built by Surat's D Khushaldas Jewellers around four months ago when the date of consecration of the idol at the Lord Ram temple was announced, said its owner Deepak Chokshi.

"Surat is famous for gold, silver and diamond, and the two silver temple replicas prepared by D Khushalbhai Jewellers were gifted to PM Modi and Bhagwatji. Four months back, we had met (UP Chief Minister) Yogiji with the temple model, and he suggested that we install Ram Lalla in the temple model and make some other changes," Mr Chokshi said.

He said it took artisans three-and-a-half months to prepare the two models and the miniature temples have been made from handicraft.

The golden crown for Ram Lalla made with gold and precious stone, and gifted to the Shri Ram Janmabhoomi Teerth Kshetra -- the Ayodhya temple trust -- was made by Surat-based Greenlab Diamonds, national treasurer of the Vishwa Hindu Parishad, Dinesh Navdia said.

Two employees from the Surat firm were sent to Ayodhya by a plane on January 5 to measure the head of the Ram Lalla idol to prepare the crown accordingly, Mr Navadia said.

The golden crown consists of four-and-a-half kgs of the yellow metal. Small and big size diamonds, rubies, pearls and sapphires, among other precious stones, have been embedded in it, the makers said. Industrialist Patel gifted the Rs 11-crore crown to the temple trust members for it to adorn the idol of Ram Lalla which was consecrated amid rituals at an elaborate ceremony in the Uttar Pradesh town, Mr Navadia said.

Gujarat Man Paints His Jaguar Saffron To Mark Ayodhya Ram Temple Event

The preparations for the grand 'Pran Prathistha' (consecration) ceremony of Ayodhya's Ram Temple on January 22 are in full swing. Amid this, a man from Gujarat, Siddharth Doshi wrapped his Jaguar car with the theme of the ceremony. 

Mr Doshi painted his luxury car in a radiant shade of saffron. The car has images of Lord Rama and the Ramayana on its sides. It also features a picture of the temple structure on the car's bonnet. Further, Sanskrit sholkas are also seen on the car. The vehicle also displays Ram Darbar and Lord Hanuman.

Mr Doshi embarked on a pilgrimage from Surat to Ayodhya. He shared several pictures and videos from his journey. In one of the posts, Mitesh Patel, Member of Parliament from Anand, Gujarat is seen posing next to him. In another post, he is pictured with Deputy Chief Minister of Uttar Pradesh Keshav Prasad Maurya and BJP MP Manoj Tiwari.

However, this is not the first time that Mr Doshi has made changes to his car. Last year, he modified his Jaguar car with India's G20 Presidency-themed films to spread awareness about it. He stated at that time that hosting the G20 group by India was a proud moment for all the countrymen.

The businessman, who is a big fan of Prime Minister Narendra Modi, drove his car from Surat in Gujarat to the national capital Delhi to spread awareness about the importance of G20.

"It is a proud moment for us and India that India is hosting the G20 this year, my simple message through my car is that people know the importance of the country," he told ANI.

Earlier, he had decorated his same car around the theme of 'Amrit Mahotsav of Independence', the 75th year of independence.

"Victims Consistently Faced Harassment": Lawyer In Brij Bhushan Case

The Rouse Avenue Court on Saturday heard the part arguments of the senior advocate for complainant women wrestlers against BJP MP and former WFI Chief Brij Bhushan Sharan Singh.

The court heard arguments on framing of charge in a sexual harassment case against Brij Bhushan Sharan Singh.

Senior advocate Rebecca John submitted that the victims consistently faced sexual assault and harassment at the hands of the accused. He also threatened one of the complainants.

There are instances of criminal intimidation and not just 354 and 354A IPC but 506 is also made out against the accused, the senior advocate argued.

Additional Chief Metropolitan Magistrate Priyanka Rajpoot heard the part arguments listed in the matter for further arguments on January 23, 2024.

During the arguments, the senior advocate mentioned the incident of alleged sexual harassment, sexual assault and criminal intimidation with the victims at different places in and outside India at Magnolia, Kajakistan, Kirghystan and Jakarta.

The senior advocate also mentioned the incidents that happened with two victims at the WFI office in New Delhi.

Senior advocate read over the statement of the victim and witnesses which corroborated the alleged incident.

Senior Advocate Rebecca John read over the statement of a Complainant who stated the 5 instances of sexual assault and harassment.

The victim stated inappropriate contact in the dining hall of a hotel in Mongolia in April 2016. She stated that the accused touched her body on the pretext of checking her breathing pattern.

The counsel argued the Gross allegations of assault within the scope of 354.

The senior advocate also submitted that one of the victims was threatened by the accused as she Tweeted about the mistreatment of players in Paris, France.

The senior counsel also mentioned the incident that happened at Bellary, Karnataka incident of injury and said "Everything is not assault there are mannerism which leads to the act". The complainant has elaborated on the incident the manner and nature in which he groped her and both the incident has been described by her to her husband.

The statement made by her husband can be treated as corroborative husband and not hearsay as the victim described the incident as soon as it happened.

The complainant's Counsel also mentioned the incident of inappropriate hugging at Sirifort Auditorium in 2018. she alleges that after she lost about, the accused inappropriately hugged her.

In her statement, the victim stated the incident of Inappropriate hugging in Jakarta, in August 2018 after winning the Gold medal. Indecent contact at the pretext of checking her breathing in Kazakhastan in 2019. There is corroboration of the incident.

"Women traditionally do not speak out...these were women from poor backgrounds....these are talented women and brought laurels to the country," the senior advocate argued.

She added, "Women who appear in the court who have faced such things at the bar also don't speak out."

If she thought of her career that must be understood, she added on the point of delay in informing the incidents to the family.

During the arguments, the counsel also read over the statement mentioning an incident in August 2018 in Jakarta where the victim won a Gold medal.

Senior counsel read the statement which stated, "I was taken to Brij Bhushan. He hugged me. I tried to free myself from his clutches but was not able as I am holding the national flag in one hand."

The fifth incident mentioned was the 2019 Olympic qualification trial in Kazakhstan. He holds my hand. My career will be spoiled. He touched me inappropriately 2-3 times

"Ram Mandir A National Temple," Says Dipika Chikhlia Who Played Sita

Dipika Chikhlia, who became synonymous with Goddess Sita due to her role in Ramanand Sagar's TV serial Ramayan, believes that the Ram temple in Ayodhya is not only about faith but also a 'rashtra mandir'.

Ahead of the 'Pran Pratishtha' ceremony in Ayodhya, Chikhlia recalled the moment when she was selected to play the role of Sita in the TV serial. Ramanand Sagar was very happy about it and even had tears in his eyes, she said.

Ms Chikhlia said that with 'Pran Pratishtha' Sanatan Dharma is finally getting its due.

"I was considered for Sita only. I had worked with Ramanand Sagar before Ramayan. So he had me in mind. But he did not want to arrive at a decision without going through auditions. He was very happy after the final audition. With tears in his eyes, he said, 'Mujhe meri Sita mil gayee'," Chikhlia told PTI in an interview.

The actor said she had visited Ayodhya in July 2023 and was totally mesmerized by the holy city. "I thought that I was in the same city that Ram Ji had ruled and lived in at one point in time." "The Ram temple is not only about faith; it is also a 'rashtra mandir' (national temple) under construction. (Ram Mandir sirf vishvas, bharosa kee hee baat nahi hai. Usske saath-saath yeh mandir, raashtra mandir kaa nirmaan hone jaa rahaa hai). This, I think, is extremely wonderful," she said.

Speaking about the ceremony, Chikhlia said, "Pran Pratishtha is very symbolic because Sanatan Dharm is finally getting its due. All our temples are getting renovated and are becoming larger than life. Due to the trust that the people have in their gods and the governance system, I think they are becoming more confident in being Sanatanis. They think that the Sanatanis also get respect in this country."

On the transformation of Ayodhya, she said, "A number of changes are being witnessed in Ayodhya. A grand temple is being built. The architecture has also changed. It is looking very beautiful, organized, and coordinated. The roads have become broad. This will give a boost to tourism and also to the economy. So, I think it's all wonderful." Chikhlia is a producer with Nazara TV and has produced a TV serial called Dhartiputra Nandini, which is the story of a family living in Ayodhya.

She was a Lok Sabha MP from Vadodara from 1991 to 1996. She was elected on a BJP ticket.

Civil Aviation Minister Jyotiraditya Scindia on Thursday inaugurated India's and Air India's first Airbus A350 aircraft on the first day of Wings India 2024.

Referring to this, Mr Wilson said, "A350 is the Airbus latest-generation aircraft, highly fuel-efficient, highly less-emissive but more importantly it comes with the world-leading product of the new Air India."

Informing about the duration to complete the full fleet, Mr Wilson said, "It will take like 2025 or 2026 to complete the full fleet, but by that time Air India will be upgraded to world-class standards."

Earlier in the day, Campbell Wilson said that the A350 is a game-changer for Air India.

"It will not only elevate our passenger experience but also open up new routes and opportunities for expansion. Together with the full interior refit of our legacy widebody aircraft beginning mid-2024, this upgradation of fleet and product is a key pillar of returning Air India to the upper echelons of world aviation," he said.

Man Rapes Woman, Kills Her By Hitting Head With Stone: Gurugram Cops

A man was arrested for allegedly killing a 34-year-old woman after raping her in this district, police said Wednesday.

The body of the woman was spotted in the hilly area near Bhondsi village on January 13, they said.

Both the accused and the woman were known to each other.

According to police, Jeevan Aharwal (28), a resident of Rajpura village in Madhya Pradesh' Chhatarpur district and the woman, a native of Sagar district, came to know each other when they worked as labourers. The accused, however, later started selling fruits.

A senior police officer said Aharwal confessed to the murder. He told police that he had raped the woman and she wanted to lodge a police complain against him so he killed her by hitting her head with a stone.

"On January 7, he took the woman to the hills of Bhondsi on the pretext of showing her a temple. He raped her and when she resisted and threatened to file a complaint, he killed her using a stone," the official said.

The forest ranger had informed the police on January 13 about the body of a woman lying in the hilly area in Bhondsi. The police reached the spot, took the body in custody, and kept it in the mortuary.

The woman's body was identified a day later by her husband, police said.

An FIR was registered at Bhondsi police station on January 14. During the investigation, a team led by Sub-Inspector Ashok Kumar arrested the accused Jeevan from near SPR Road on Tuesday night, they said.

"We have taken the accused on two days' police remand after producing him in a city court today. We are questioning him," Gurgaon police spokesperson Subhash Boken said on Wednesday.

"Dissent Should Be Expressed Within Bounds Of Dignity Of House": Om Birla

Lok Sabha Speaker Om Birla on Tuesday said that dissent should be expressed within the bounds of dignity and decorum of the House.

Addressing the valedictory session of the orientation programme for members of the Rajasthan Assembly, Mr Birla said it is a matter of utmost importance for the members to establish the highest standards of conduct in the House.

"In a democracy, there may be differences of opinion on policies and issues, but disagreements and dissent should be expressed within the bounds of dignity and decorum of the House," he said.

Mr Birla emphasized that there should not be any disruption in the House during addresses of the president and the governor.

YSR Congress Resorting To "Bogus Vote Racket": Chandrababu Naidu

Telugu Desam Party (TDP) chief Chandrababu Naidu on Monday alleged that fearing losing power in the forthcoming assembly polls, the YSRCP government is resorting to a "bogus vote racket."

Chandrababu, who was here in a village to celebrate the Makara Sankranthi along with his family members, visited the party leader, Pulivarthi Nani, at Chandragiri who has sustained grievous injuries when he recently doused himself with kerosene in front of the local Revenue Divisional Officer's (RDO) office, demanding deletion of bogus voters.

Talking to media persons at Chandragiri, Chandrababu said that the Election Commission should take the "irregularities" in the voter lists in the Chandragiri Assembly segment as a case study. The former chief minister came down heavily on the ruling YSRCP stating that it is resorting to largescale irregularities that even the dacoits do not dare to indulge in.

Observing that generally, it is the duty of the polling officials to enroll the voters, he alleged that the YSRCP leaders are doing this in the State and are "deleting" the votes of the TDP sympathisers. "What is happening in the Chandragiri Assembly segment is certainly a case study with regard to enrollment of voters," Chandrababu remarked.

The TDP supremo said that the Election Commission has recently expressed anger at the Tirupati District Collector and the Superintendent of Police (SP) and questioned what steps they have taken to check the recurring irregularities that took place in the Lok Sabha bypolls here.

Pulivarthi Nani has been fighting for the past six months against the "deletion of the votes of the TDP sympathisers," Mr Naidu added.

"In fact, I am getting frustrated watching the activities of these people. I have never seen such kind of criminals in my lifetime as the Form-6, Form-7 and Form-8 have been utilised at will in all the 11 Assembly segments in the combined Chittoor district," Chandrababu claimed.

Claiming that in the last elections, the district had only 2.90 lakh votes, the TDP chief expressed surprise that the number of voters has gone up "so steeply to 3.08 lakh." In Thummalagunta now there are seven booths as against four last time, he added.

"I am really surprised to know that the voters enrolled fresh are of the age of 40 to 80 years and from where they have come here now," he asked. 

Also, 13,928 votes are with similar photographs while voters are enrolled in Tirupati and Chandragiri segments with the names of Sangeetha Hari and Hari Sangeetha while in the name of Sravya Duvvala and Duvvala Sravya are enrolled in Srikalahasti and Chandragiri segments, Chandrababu claimed.

In the name of Mallaguntla Mahesh voters are enrolled in Peeleru and Chandragiri segments, the TDP supremo further claimed and added that all this indicates how the officials "colluded with the ruling party leaders." Making it clear that it is the primary responsibility of the officials to see to it that there are no irregularities in the voter lists, Chandrababu said that if the officials are found responsible for such irregularities they may even be sent to jail.

Chandrababu Naidu said that the people have already decided to send the YSRCP home. "The officials should function as per the norms and if they are found violating the guidelines they will be sent to jail by the coming TDP-Jana Sena combine government," the former chief minister said.

Sack Narayan Rane From Cabinet Over Shankaracharya Remark: Thackeray Sena

The Shiv Sena (UBT) has demanded the dismissal of Union Minister Narayan Rane from the Union cabinet for questioning the "contribution" of Shankaracharyas to the Hindu religion.

The Uddhav Thacerkay-led party also sought a public apology from the BJP ahead of the consecration ceremony of the Ram temple in Ayodhya over Mr Rane's comments.

Shiv Sena (UBT) ally Congress staged a protest at the party office in Mumbai against Narayan Rane on Sunday.

Speaking to reporters in Palghar, Mr Rane said the Shankaracharyas should bless the Ram Temple instead of criticising some aspects and accused them of looking at Prime Minister Narendra Modi and the BJP through a "political prism".

"No one could do it until now. PM Modi and the BJP took it up and a temple is being built. Should they bless the temple or criticise it? It means Shankaracharyas look at Prime Minister Narendra Modi and the BJP through a political prism. This temple is not built on politics but on religion. Lord Ram is our God," he said.

"The Shankaracharyas should tell what is their contribution to the Hindu religion," he said.

Addressing a rally on Saturday night, Shiv Sena (UBT) leader Uddhav Thackeray said the BJP should issue a public apology ahead of the consecration of the Ram temple for the "derogatory" remarks made by Mr Rane against Shankaracharyas. He also demanded the BJP expel Mr Rane.

Speaking to reporters on Sunday, Shiv Sena (UBT) MP Sanjay Raut said Mr Rane insulted Hinduism by questioning the contribution of the Shankaracharyas.

"The BJP must apologise before January 22. We demand that Prime Minister Narendra Modi sack Mr Rane from the Union cabinet," Mr Raut said.

Supriya Sule, the working president of the Sharad Pawar-led Nationalist Congress Party, said it was for the BJP to respond to Mr Rane's comments.

On Friday, the VHP's working president Alok Kumar said two of the four Shankaracharyas have "openly welcomed" the upcoming consecration ceremony, but none would attend the grand event in Ayodhya.

They will visit the Ram temple later "as per their convenience", he told PTI.

The Opposition has been targeting the BJP over reports of respective Shankaracharyas of Shri Shringeri Sharda Peeth Karnataka, Dwarka Sharda Peeth in Gujarat, Jyotir Peeth in Uttarakhand and Govardhan Peeth in Odisha deciding not to attend the consecration ceremony.

Jyotirpeeth Sankaracharya Swami Avimukteshwaranand Saraswati reportedly said it would not be right to perform a consecration ceremony at this stage as the construction is not complete yet.

"Bury Dynasty Politics": Uddhav Thackeray In E Shinde's Son's Constituency

Shiv Sena (UBT) chief Uddhav Thackeray on Saturday asked people to end dynastic politics as he toured the Kalyan Lok Sabha constituency in Maharashtra which is represented by Shrikant Shinde, son of Chief Minister and president of the rival Sena faction Eknath Shinde.

Speaking at a rally, he also said Prime Minister Narendra Modi's repeated visits to Maharashtra underline the state's importance in the coming Lok Sabha elections.

"It is time we showed traitors their place," he further said, taking a swipe at Eknath Shinde who rebelled against Thackeray's leadership in June 2022 and brought down his government. Modi himself will deny tickets to "traitors", failing which the people of the state will dump them along with the BJP in the dustbin in the coming elections, Thackeray said.

"Use and throw" was the BJP's policy, he alleged.

Thackeray, whose party is a constituent of the Maha Vikas Aghadi alliance, also expressed satisfaction at the presence of local leaders and workers of allies Congress and Sharad Pawar-led NCP in the audience.

Opposition's solidarity was important for saving the country, he added.

Amid Severe Cold Wave, Patna Schools Upto Class 8 Shut Till January 16

Cold wave conditions gripped Bihar on Friday with the mercury dipping below 10 degrees Celsius in several districts.

Gaya recorded the lowest temperature in the state at 4.9 degrees Celsius, according to an India Meteorological Department (IMD) report.

The IMD predicted that minimum temperatures were likely to remain between 9 and 12 degrees Celsius over the next four to five days in several parts of the state, including Patna.

According to the IMD report, Banka was the second-coldest at 6.3 degrees Celsius, followed by Motihari (6.8), Sabour in Bhagalpur at 7 degrees Celsius, Dehri (7.2) and Kaimur (7.6).

State capital Patna recorded a minimum temperature of 8.1 degrees Celsius.

Low visibility due to foggy conditions was reported from different parts of the state, the weather office said.

The maximum temperature of 22.2 degrees Celsius was registered at Forbesganj in Araria district.

Meanwhile, Patna District Magistrate Chandra Shekhar Singh ordered the closure of all government and private schools up to class 8 till January 16 due to the prevailing severe cold conditions.

The order will be effective across the Patna district.

"It has been made to appear to me that due to prevalent cold weather and low temperature prevailing particularly in the morning in the district, the health and life of children are at risk.

"Therefore, I... hereby prohibit the academic activities of all the private and government schools (including pre-schools and anganwadi centres) of the district up to class 8 till January 16," the DM's order stated.

Agent Of Pak Intelligence Agency ISI Arrested In Uttar Pradesh: Cops

The Uttar Pradesh Police's STF has arrested an alleged agent of Pakistani intelligence agency ISI in Muzaffarnagar district, officials said here on Thursday.

A UP Special Task Force (STF) statement said Tehseem alias Mota, a resident of Shamli district, was arrested in Budhana area of Muzaffarnagar on Wednesday. He was charged with disturbing the unity, integrity and social harmony of the country by collecting weapons as part of a conspiracy hatched with the Inter-Services Intelligence (ISI).

On August 2 last year, the STF had arrested a person named Imran after recovering fake currency from him. On August 16, the agency arrested a criminal, Kalim, for gathering weapons with the help of ISI.

The STF said Tehseem was absconding in both these cases.

The agency said during interrogation, Tehseem disclosed that his brother Kalim keeps visiting Pakistan. He asked him to prepare his people to "disturb the communal harmony, work to create riots in India and make it an Islamic nation by implementing Shariat law in the country". He was promised a lot of money for carrying out these nefarious activities, the statement read.

The STF claimed that Tehseem also said he and his brother Kaleem had obtained fake mobile SIM cards and were in touch with another ISI agent, Dilshad alias Mirza in Pakistan, through WhatsApp and used to pass on sensitive information to him.

According to the statement, the FIR against Tehseem has been registered in Shamli district.

Greater Noida Man Shoots Self To Allegedly Frame Loanee For Attack

A 25-year-old man in Greater Noida allegedly shot himself in the arm on Wednesday to implicate a friend in a case of attack, police officials said.

The incident took place around 8.30 am in the Kaanth Mandi area under Dadri police station limits, they said.

"The man, identified as Tanuj Nagar, had lent around Rs 15 lakh to Rishabh Gupta two years ago. The repayment of the loan was allegedly getting delayed. Nagar had come to Gupta's house for repayment on his call," a police officer said.

"Nagar was accompanied by another friend who stood outside Gupta's house as the two talked inside. Later, Nagar pulled out a firearm and shot himself in his arm after which he ran out of the house," the officer said.

This, the policeman said, was allegedly done to implicate Gupta in a criminal case.

Nagar was later taken to a hospital for treatment where his condition is stated to be out of danger, according to the police.

No case has been registered yet in the case but the police said they are ascertaining facts of the matter and checking documents of the gun before initiating any legal proceedings, they added. PTI KIS CK

Officials To Inform Bosses Before Giving Papers To External Agencies: Jharkhand

The Jharkhand cabinet on Tuesday approved guidelines to deal with notices to state officials by external probe agencies, making it mandatory for them to inform the Cabinet Secretariat and Vigilance Department through departmental heads about the communications, an official said.

The decision came when Chief Minister Hemant Soren and a number of state government officials are facing summons by the Enforcement Directorate (ED).

The cabinet's decision to formulate a standard operating procedure (SOP) was taken at a meeting chaired by Soren in view of "handing over of documents to external probe agencies without bringing this to the knowledge of state officials concerned".

Briefing the media after the meeting, Cabinet Secretary Vandana Dadel said, "The cabinet secretariat and vigilance department have been made nodal departments to deal with such issues and legal actions in the matter." She said that according to the new SOP, if any official receives any notice or summons from any external probe agency, he or she will immediately inform the department head concerned.

"The nodal department will obtain legal advice accordingly. In light of the advice from the department, the official will provide necessary cooperation to the probe agency," Dadel said.

According to a cabinet note, it came to the notice of the state government in recent past that many summonses or notices were issued directly to officials asking them to appear before external probe agencies without providing information to the competent authority of the state government.

"In many cases, government documents/records are also demanded by an (external) investigating agency.

"In certain cases,… officials hand over the documents/records to the agency without bringing it to the notice of their senior officer/departmental head, which is not in accordance with the prevailing rules. This adversely affects the activities of the state government," the note read.

The ED has summoned the chief minister and several officers for questioning in connection with alleged corruption cases.

The central agency in its latest summons to Soren, who is also the executive president of the JMM, has asked him to inform the investigating officer about the date, venue, and time of his choice so that his statement could be recorded under the Prevention of Money Laundering Act (PMLA).

The probe pertains to a "huge racket of illegal change of ownership of land by the mafia" in Jharkhand, according to the ED.

Soren has skipped six earlier summonses by ED accusing the union government of using central agencies to destabilise his democratically elected government. The seventh summons was issued in December last year.

The agency has also summoned Soren's press adviser Abhishek Prasad and Sahibganj Deputy Commissioner Ram Niwas Yadav for questioning in a money laundering case investigation linked to alleged illegal mining in the state, officials said.

While Prasad alias Pintu has been asked to depose at the federal agency's Ranchi office on January 16, Yadav and another person Binod Singh were instructed to do the same on January 11 and 15 respectively.

The sources said their statements will be recorded under the PMLA.

The ED had earlier raided their premises and those of Sahibganj Deputy Superintendent of Police Rajendra Dubey and several others on January 3.

Punjab Cops Seize 3.5 Kg Of Heroin, Arrest 3 In Drug, Arms Smuggling Racket

The Punjab Police on Monday said it has arrested three more people and seized 3.5 kg of heroin during an investigation connected to a cross-border drug and arms smuggling racket busted on December 31.

Director General of Police (DGP) Gaurav Yadav said they were identified as Balraj Singh alias Kaka of Lahorimal village in Amritsar, and Anmol Singh alias Laalu and Sarabjit Singh of the city's Ranjhe di Haveli area.

With this, the total number of arrests now stands at 10 and the quantity of heroin seized is 22.5 kilograms.

Gaurav Yadav said police have also seized 10 live cartridges of .30 bore and nine live cartridges of 9 MM, along with a car from their possession.

The development came more than a week after the police commissioner of Amritsar busted the racket that was being operated by US-based smuggler Mannu Mahawa.

Commissioner of Police (CP), Amritsar, Gurpreet Singh Bhullar said Anmol Singh and his accomplices were caught after being spotted in the Sultanwind area.

As per preliminary investigations, the accused were in touch with a Pakistan-based smuggler and Mahawa, and were supplying drugs, arms, and ammunition across the state after smuggling them via drones, he added

Indian High Commission Raises Issue Over Remarks Against PM With Maldives

The Indian High Commission in Male on Sunday raised with the Maldivian government the issue of derogatory comments made against Prime Minister Narendra Modi by certain lawmakers, even as Male distanced itself from these remarks and asserted that "personal" views do not represent its position.

Sources said the Indian mission in Male objected to certain social media posts against the prime minister that came after his visit to Lakshadweep.

A Maldivian lawmaker criticised PM Modi following his Lakshadweep trip inferring that New Delhi is attempting to project the Union Territory as an alternative tourist destination to the Maldives.

"The government of Maldives is aware of derogatory remarks on social media platforms against foreign leaders and high-ranking individuals. These opinions are personal and do not represent the views of the government of Maldives," the Maldivian foreign ministry said in a statement.

It said the government believes that the freedom of expression should be exercised in a democratic and responsible manner, and in ways that do not spread hatred, negativity and hinder close relationships between the Maldives and its international partners.

"Moreover, the relevant authorities of the Government will not hesitate to take action against those who make such derogatory remarks," it said.

The Maldives is one of India's key maritime neighbours in the Indian Ocean Region and the overall bilateral ties including in areas of defence and security witnessed an upward trajectory under the previous government in Male.

The new president, Mohamed Muizzu, is seen to be close to China. After taking charge of the top office over a month back, he called for the withdrawal of Indian military personnel from the Maldives.

Minister's "House Should Be Burned": Samajwadi Party Leader's Shocker

A Samajwadi Party leader has come under police scrutiny for allegedly calling for burning down the house of a BJP member who reportedly thrashed Dalit councillors from opposition parties in a Meerut Municipal Corporation Board meeting.

A video which surfaced on social media purportedly showed SP leader Mukesh Siddharth making the statement. Police have taken cognisance of the video and begun investigating.

Mukesh Siddharth, a former vice-chairman of the Uttar Pradesh Scheduled Caste-Tribe Commission, made the statement while talking to journalists during a protest at the Collectorate here on Saturday.

"If Minister of State Somendra Tomar is not arrested by January 10, then … his house should be burned, his car should be burned, he should be burned and the city should be burned," the SP leader allegedly said.

He added, "This is just a spark, when it becomes a volcano, the government will also come to know." Mr Siddharth alleged that despite a complaint against the minister, no action was taken against him.

Superintendent of Police (City) Ayush Vikram Singh told PTI that "Taking cognizance of the viral video of Mukesh Siddharth, the police have started their investigation." Members of the BJP and opposition parties came to blows during a Meerut Municipal Corporation Board meeting on December 30.

BJP and opposition leaders accused each other of starting the row aand filed cross complaints.

It is alleged that during the meeting, BJP's Legislative Council Member Dharmendra Bhardwaj was pushed and assaulted by the councillors of the opposition parties, after which the BJP councillors got enraged and attacked the Bahujan Samaj Party Councillor from Ward 36.

Ashish Chaudhary and SP councillor from Ward 31 Kuldeep alias Kirti Ghopla were allegedly beaten up in the fight.

The opposition councillors also accused, besides Bhardwaj, Minister of State for Energy Somendra Tomar of beating up Dalit councillors.

In the wake of the row, SP President Akhilesh Yadav, BSP President Mayawati, Rashtriya Lok Dal President Jayant Chaudhary, and Congress State President Ajay Rai threw their lot behind the Dalit councillors and slammed the BJP.

Jayant Chaudhary met the Dalit councillors in Zahidpur on Monday. They were earlier paid a visit by Congress State President Ajay Rai and Azad Samaj Party National President Chandrashekhar Azad.

Chandrashekhar Azad, who came to Meerut to meet the councillors, announced a Panchayat in the city on January 10 to discuss the matter.

Less Than Respectable Share Of Lok Sabha Seats In Bihar Will...: Congress

The Congress on Saturday claimed that a less than "respectable" share of Lok Sabha seats in Bihar would affect not just the party, but the entire ruling ‘Mahagathbandhan', including Chief Minister Nitish Kumar's JD(U).

State Congress president Akhilesh Prasad Singh made the statement when he was asked about speculations in a section of the media that the party has been asked to settle for not more than four out of 40 Lok Sabha seats in the upcoming general elections.

"The Mahagathbandhan as a whole, including the JD(U), will suffer if the Congress fights only four seats, though it is not our case that we be given nine just because we had contested that many in 2019,” said Singh.

Reports have surfaced in a section of media that JD(U) wants 17 seats for itself, as many as it had contested five years ago, winning all but one.

A key aide of Kumar has made it clear that for the JD(U), a number less than 16, its current strength in Lok Sabha, was out of question.

"We have 16 seats. On these, the question of a claim or any confusion should not arise,” JD(U) national general secretary Sanjay Kumar Jha said.

Jha also said "whatever may be the demand of the Congress, it should convey the same to the RJD. We will be sitting across the table with the RJD for final discussions on seat sharing”.

The JD(U) leader's averment was in the backdrop of a general understanding reached within the Mahagathbandhan that since the chief minister's party was a new entrant, having joined the coalition after dumping the BJP less than two years ago, the RJD, the largest constituent, be allowed to negotiate on behalf of smaller partners.

A statement to this effect was made some time ago by CPI (ML) Liberation general secretary Dipankar Bhattacharya, who had said the number of seats his party desired has been shared with RJD supremo Lalu Prasad, who would negotiate on behalf of other junior partners with the JD(U).

No RJD leader has, so far, hinted the number of seats the party wanted to contest and Prasad's son Tejashwi Yadav, the deputy CM, denied having taken up the issue with Kumar.

“He is the CM and I am the deputy. There can be any number of issues for us to discuss. Do not worry too much about seat-sharing. We will let you know in due course,” said Yadav, when journalists approached him with queries.

Mahagathbandhan leaders are of the view that the RJD, which is numerically far superior to the JD(U) in the assembly, would have liked to have the lion's share of Lok Sabha seats.

Its bargaining power has, however, been hit because of its dismal performance in the general elections of 2019 when it failed to win a single seat.

The BJP-led NDA, which then included JD(U), had won 39 out of 40 seats while the Congress bagged Kishanganj, becoming the lone Mahagathbandhan constituent to have escaped the ignominy of drawing a blank at the hustings.

However, sources in the Mahagathbandhan added it was unlikely that the RJD would agree to a share smaller than the JD(U), especially in the light of the fact that Kumar has indicated that in the next assembly polls, it will be Tejashwi Yadav who will lead the charge for the coalition.

In the event of both JD(U) and RJD deciding to contest 17 seats each, the Congress, CPI(ML) L, CPI and CPI(M) will have to be accommodated in the remaining six.

Sanjay Kumar Jha was also asked whether by insisting on a high number of seats, JD(U) was trying to put pressure on Congress for naming Kumar as the convenor of INDIA.

“Nitish Kumar has already made it clear that he has forged opposition unity to defeat the BJP. He desires nothing for himself. We want seat-sharing to be complete by this month because this was the view expressed by our leader at last month's INDIA meet in Delhi. He feels we cannot afford to lose much time,” Jha said.

When Akhilesh Prasad Singh was asked the same question, he replied: “The Congress has great appreciation for the contribution made by Kumar in cobbling together the coalition. But, to name him as the convenor is not entirely in the hands of our party. There needs to be a consensus among other constituents of INDIA. Talks are on.”

Mizoram Chief Minister Lalduhoma On Key To Stop Violence In Manipur

Mizoram Chief Minister Lalduhoma on Friday said there has to be a political solution to the ongoing ethnic strife in neighbouring Manipur, adding that there is no "magic solution" to stop violence in Manipur.

Responding to a query on reports of fresh violence in Manipur, he said, "(It will) keep on happening unless and until we find a solution. But the solution is not with me. It lies with the Chief Minister of Manipur."

Asked what would be his suggestion to his Manipur counterpart N Biren Singh, Lalduhoma said, "There has to be negotiations. There is some demand from the tribal population and tribal leaders. That has to be discussed with the Union Home Ministry. A political solution has to be there."

Lalduhoma was in Kolkata to attend an interactive session of the Merchants' Chamber of Commerce.

Responding to a query whether his government will facilitate any discussion to stop violence in the neighbouring state, the Mizoram Chief Minister said, "No I am an outsider."

To a question on Mizoram facing the brunt of ethnic violence in Manipur with internally displaced people (IDPs) streaming in from the neighbouring state, Lalduhoma said, "On humanitarian grounds, we have to look after them. We are taking care of them. There is no problem. They are not foreigners. They are Indian citizens."

According to an official of the Mizoram Home Department, around 9,000 displaced people from Manipur are now living in Mizoram.

More than 180 people have been killed and several hundred injured since ethnic violence broke out in Manipur on May 3 last year when a Tribal Solidarity March was organised in the hill districts to protest against the majority Meitei community's demand for Scheduled Tribe status.

"Centre Is Not Hostile To Tamil Nadu" On Funds' Flow: Nirmala Sitharaman

The Centre was never hostile towards Tamil Nadu, Kerala or any other state on ensuring funds flow and had made advance payments and even released funds to foster infrastructure development, Union Finance Minister Nirmala Sitharaman said on Thursday.

Responding to a criticism from the DMK government that the central government was not disbursing funds or settling its share, she said from 2014 to 2023 the Centre received Rs 6.23 lakh crore as direct tax (income tax and corporate tax) from Tamil Nadu but gave back Rs 6.96 lakh crore to the state during the same period.

"I will get the update on the current figures only in March. But as per the available statistics, from 2014 till 2022-23, Tamil Nadu's direct tax collection was Rs 6.23 lakh crore. But we gave Rs 6.96 lakh crore to the state," she said while speaking at the Viksit Bharat Sankalp Yatra programme here.

"It is a wrong assumption that this Rs 6.23 lakh crore is paid only by the people of Tamil Nadu. Among them were Hindi-speaking tax assessees," the Finance Minister said.

She had to put the record straight as there has been a misinformation campaign that the BJP-led union government was not prompt in releasing funds to states.

"You are asking to give back your tax money. The Central government has been giving back the Cess, tax or even the GST collected from TN and in addition providing additional funds," Nirmala Sitharaman said.

Post-COVID, going beyond the Finance Commission's recommendations, Prime Minister Narendra Modi had asked her Ministry to provide special capital assistance to the states to foster their infrastructure development, she noted.

The Modi government has settled dues amounting to about Rs 81,645 crore pending since 1996-97 to all states and Tamil Nadu's share in it was Rs 3,225 crore.

The money obtained as cess and surcharge were also given back to the state for the construction of schools and roads, Pradhan Mantri Awas Yojana (Rural) and Gram Sadak Yojana. About Rs 57,557 crore was obtained by way of cess and surcharge from Tamil Nadu from 2014 till date. Of the sum, Rs 37,965 crore was disbursed to construct NHAI roads, Rs 11,116 crore from education cess for Samagra shiksha overarching programme for school education, Rs 4,839 crore for PMAY, Rs 3,637 crore for the rural roads scheme in the state.

Of the Rs 36,353.12 crore collected as GST from Tamil Nadu in 2022-23, the Centre released the entire sum to the state and in addition provided 41 percent from the Rs 27,360 crore CGST collection. "We have given the GST entirely to the state governments without discrimination," she added.

"You are blaming the Centre is not giving funds. The Finance Commission decides on the sum to be given to each state. The Centre is not hostile to Tamil Nadu, Kerala or any state and does not retain the sum due for them. The amount is disbursed on a monthly basis and in certain cases, advance payment is made during festivals," she said.

As the Minister concluded her speech, a woman who had come to attend the function, sought to know if she would get the flood relief sum. Immediately Nirmala  Sitharaman replied "you will get it. We will look into your case if you provide us the details." The Finance Minister handed over cheques to beneficiaries under various central government schemes such as Mudra Yojana, Stand up India, and PM SVANidhi, at the event.

Cold Wave Grips Delhi, Temperature Settled Four Notches Below Normal

It was a bone-chilling cold in the national capital on Wednesday with the maximum temperature settling at 15.7 degrees Celsius, four notches below the normal, the weather department said.

Safdarjung, Delhi's main weather station, recorded a visibility of 200 meters at 8:30 am, while the minimum temperature was recorded at 7.3 degrees Celsius, below the normal for the season's average.

"In Delhi, the temperature is set to hold steady over the next two days, while in some areas it may drop to around 6 or 7.5 degrees Celsius," said Kuldeep Srivastava, scientist and head, of Regional Weather Forecasting Centre.

Srivastava said the first ten days of January are considered the coldest, but it's relatively warmer this year compared to the previous year.

"The minimum temperature has not yet dropped to 2 or 3 degrees, unlike in previous years when it occurred for one or two days," an official of the India Meteorological Department (IMD) told PTI.

According to the Indian Railways, 26 Delhi-bound trains were delayed by one to six hours due to fog.

The humidity levels oscillated between 75 per cent and 100 per cent on Wednesday.

The IMD has forecast moderate fog for Thursday with the maximum and minimum temperatures likely to settle around 17 and 7 degrees Celsius respectively.

The 24-hour average Air Quality Index (AQI) recorded at 4 pm was 341, which stands in the "very poor" category.

An AQI between zero and 50 is considered "good", 51 and 100 "satisfactory", 101 and 200 "moderate", 201 and 300 "poor", 301 and 400 "very poor", and 401 and 500 "severe".

Not Tenable At This Stage: Court Rejects 12-Year-old's Abortion Petition

The Kerala High Court has declined a plea requesting the termination of the pregnancy of a 12-year-old girl, allegedly in an incestual relationship with her minor brother. The court noted that the foetus, now at 34 weeks, is fully developed and preparing for life outside the womb.

The court stated that termination at this stage is not tenable, if not impossible, and the child must be allowed to be born through either a caesarean section or normal delivery, a decision left to medical experts.

The parents argued that childbirth would have severe consequences on the girl's physical and mental well-being.

In its December 22 order, the court allowed the petitioners to seek continuous assistance from doctors at the nearby Government Medical College.

After reaching 36 weeks of gestation, they can approach the Medical College Superintendent for evaluation by experts, who will then decide on the nature of delivery.

The court assured protection for the baby after birth, emphasising the girl's comfort with her parents until delivery.

The parents were directed to ensure the accused brother stays away from her, with competent authorities enforcing this directive.

The court emphasised maintaining the petitioners' anonymity throughout the process and thereafter.

Ahead of Delhi Chief Minister and Aam Aadmi Party (AAP) Chief Arvind Kejriwal's appearance before the Enforcement Directorate in connection with the alleged excise policy scam, Congress leader Navjot Singh Sidhu on Monday attacked him citing an old 'X' post of his.

Mr Kejriwal, earlier, wrote in an 'X' post, "As a patriot Indian, my head hangs in shame when our corrupt leaders do not appear before ED and CBI even after multiple summonses by the investigating agencies when they should have resigned from their post immediately as soon as the allegations were made."

Earlier in December, Mr Kejriwal skipped ED summons twice, which were issued to him in connection with the alleged excise policy scam. 

As per ANI sources, Mr Kejriwal is likely to appear before the Enforcement Directorate on January 3 in connection with the excise policy case.

On December 22, ED issued a third summons to Chief Minister Kejriwal in connection with the excise policy case, asking him to appear before the agency on January 3.

Mr Kejriwal was issued the second summons by the ED on December 18, asking him to depose at the federal agency's office on December 21, which the Chief Minister skipped.

The Delhi Chief Minister was first called by the central agency to appear on November 2, but he did not depose, alleging that the notice was "vague, motivated and unsustainable in law."

Mr Sidhu took a swipe at the Delhi CM, stating, "Practice what you preach".

"Practice what you preach...face the ED music even if you don't like the tune ... resign from your post till you come clean like I did in Dec 2006," he wrote in a post on 'X'.

Earlier in 2006, Mr Sidhu (then BJP leader) had resigned from the post of Lok Sabha MP following his conviction in a case of death in a road rage involving him.
